As reported widely in the Spanish press this week - a naturist group is poised to take legal action against El Ejido council after it banned baring all on its beaches. Naturist associaiton, La Asociación de Naturistas-Nudistas de Andalucía (ANNA) believes that the position taken by El Ejido council is “illegal” and “anti-constitutional” and is currently taking legal advice.
The ban was introduced last December as part of widespread council reforms despite the best efforts of group members. ANNA spokesman, Rafael Ortiz, revealed he wrote to town mayor, Juan Enciso, last summer while the bill was being drawn up, warning him of its illegality and of their intention to challenge it.
Ortiz cited a ruling from the High Court of Andalucia (TSJA) which proved “this current bill only serves to terrorise normal citizens because it has no legal foundation”.
Mayor Enciso has denied ANNA’s claims. He explained: “Nobody challenged this decision while the bill was being drawn up.” He said that nudism was not allowed in any El Ejido beaches and that no official requests had been made to allow the creation of one.
